You’ve Hired Us. Now What?

Once you’ve made the decision to retain our office, immediately refer all of your creditors to our office.  You do not need to spend any more of your valuable time dealing with intrusive, harassing phone calls.  In addition, our attorneys generally recommend that you cease paying the debts that are going to be discharged in your bankruptcy (with some exceptions).

The first step is to fill out a packet of information that our office provides.  This information will help us properly prepare your bankruptcy petition.  When that information is completed, you have an initial meeting at our office.  Along with the competed packet, you will need to bring your credit reports and tax returns (if you are required are file tax returns).  You are also required to complete a credit counseling “class,” the majority of which can be completed on-line in less than two hours.

Once we have all your data, you will have an appointment in our office to sign your final paperwork.  This appointment will take at least an hour.  We are very thorough in preparing your paperwork, and in ensuring that you have disclosed everything in your final petition (the bankruptcy trustees often comment on how professional our paperwork looks relative to other attorneys).        

Once the case is filed, a hearing will be scheduled.  This hearing is typically about 4 weeks after the case is filed.  Creditors have the opportunity to appear at this hearing, but they usually do not, and the hearing is typically uneventful.  Following the hearing, it usually takes about 75 days until you receive your discharge (the Court Order that you are no longer responsible for your debts).  In total, from the time the case is filed until you get your discharge usually takes about 4 months.
